СУЧАСНИЙ СТАН ПРАВОВОГО РЕГУЛЮВАННЯ ФУНКЦІОНУВАННЯ ВОДНОГО ТРАНСПОРТУ УКРАЇНИ ТА РЕСПУБЛІКИ МОЛДОВА: АДМІНІСТРАТИВНО-ЮРИСДИКЦІЙНІ АСПЕКТИ

Abstract

This article adresses the comparative analysis of the individual administrative and jurisdictional aspects of organization of management in the field of water transport of Ukraine and the Republic of Moldova. The current state of development of the water transport system of Ukraine and Moldova has been characterized. The description of the regime of the temporarily occupied territory and its boundaries in the water areas of Ukraine is given, which determines the possibility of exercising jurisdiction in the field of water transport. It is indicated on the necessity of taking legal and organizational measures to improve such a regime. The analogy of the regime of the temporarily occupied areas of the historical inland waters of Moldova, which limits the ability to exercise the jurisdiction in the part of the river bed of the Dniester River, is given. The necessity of adoption and implementation of the draft Law «On Inland Water Transport» is indicated, which will make it possible to regulate legal relations in the field of navigation on inland waterways of Ukraine, as it has already been done earlier in Moldova. The description of the status of the captain on inland water transport as a subject of the administrative jurisdiction, in accordance with the legislation of Moldova is given. The classification of legal regimes of Ukrainian water areas has been analyzed, which determine the various forms of implementation of administrative jurisdiction on sea and inland water transport. The theoretical and practical ways of improvement of legislation in the field of organization of management on water transport have been proposed.
