ҐЕНЕЗА ТА СТАНОВЛЕННЯ СУДОВИХ ІНСТИТУТІВ КИЇВСЬКОЇ РУСІ

Abstract

The article defines historical prerequisites for the establishment of judicial institutions of Rus’s lands. It has been found that intensive internal and external trade, social division of labor, urbanization of living space and the introduction of Christianity caused the involuntary transformation of customary law into legal codes codified in the Rus’s Pravda, which in unity with the market area of capital cities became fundamental in the judicial system of Rus’s lands. It is proved that the judicial institutes were genetically related to the peoples institutions and constituted the only state organism in the whole expanse of the Rus’s lands.
