ОЗНАКИ КОРУПЦІЇ ЯК ВИЗНАЧАЛЬНИЙ ЧИННИК РОЗДІЛУ 13-А КУПАП «АДМІНІСТРАТИВНІ ПРАВОПОРУШЕННЯ, ПОВ’ЯЗАНІ З КОРУПЦІЄЮ»

Abstract

In article the attempt to consider administrative offenses is made, are connected by it with corruption, through a prism studying of existence of signs of corruption. In particular reasonably need of change of the name of Section 13-A QAQ ««administrative offenses releated to corruption»on ««administrative corruption offenses». Due to formal-logical and hermeneutical methods defined on the basis of a number of domestic and international acts of the special signs of corruption, which are inherent in a corruption offense. Completed legal analysis of the offenses contained in Section 13-A of the QAQ for the purpose of identifying corrupt features through a system of objective and subjective characteristics. On the example the analysis of the appropriate dispositions of the articles clarified the key features that make it possible to classify the latter as corrupt according to signs of corruption.
