ПОРІВНЯЛЬНО-ПРАВОВИЙ АНАЛІЗ АДМІНСТРАТИВНОЇ ВІДПОВІДАЛЬНОСТІ У СФЕРІ ВОДНИХ РЕСУРСІВ В УКРАЇНІ ТА ЄВРОПЕЙСЬКОГО СОЮЗУ

Abstract

The article examines that the process of integration of our country into the European Union requires certain necessary changes in various spheres of public life, such as political, cultural, social, economic, legal, etc. Among all these components (constituents), the legal component plays an important role. After all, the goal of successful integration requires an appropriate level of coherence of the national legal system, where the main component is the system of legislation and the practice of its implementation in the legal system of the European Union. It turns out that integration is a concept that should cover all spheres of public life of the state. An important place among such areas belongs to natural resources. Water plays a special role in this, because water is an essential component of the environment. In any case, the use of water resources should be rational, because according to experts, Ukraine is one of the least well-resourced countries in Europe in terms of water resources per capita. In this regard, our state’s water policy should be based on the rational use of such a natural component, and therefore there is a need for some mechanisms to encourage such use. The results are summarized as to the necessity and in view of the course of Ukraine on European integration necessary, in the conditions of today there is a revision of the existing institute of administrative responsibility for offenses in the sphere of use and protection of water resources. Namely, it is necessary to increase the existing system of fines, as well as to introduce the polluter pays principle, in connection with which Ukraine will be able to move even closer and meet the requirements imposed by the European Union on the Member States.
