АДМІНІСТРАТИВНО-ПРАВОВІ МЕТОДИ ПРОТИДІЇ ОРГАНІЗОВАНІЙ ЗЛОЧИННОСТІ В УКРАЇНІ

Abstract

The article deals with a rather important problem - administrative and legal methods of combating organized crime, which enable the subjects of combating organized crime to achieve the goals of their activity, to apply specific means and methods for the implementation of tasks, functions, competences and powers, to determine the peculiarities of each of them. The article analyzes the scientific opinions on the general theoretical understanding of the “method” and noted that in scientifi c works such concepts as “management methods”, “methods of public administration”, “methods of public administration”, “methods of administration”, “methods of administrative law “, etc., which, in the author’s opinion, are interconnected, since they have one basis - management. The author’s opinion on the understanding of administrative and legal methods of combating organized crime is offered. Scientists believe that a proper understanding of the methods is possible on the basis and in connection with the functions of control, and that any function that requires implementation is a specific purpose of management and actions related to the tasks of its implementation, which allows to separate methods from such concepts as: planning, control, accounting and other similar actions of management. The content and essence of administrative and legal methods regarding their peculiarities of use (use) by the subjects of combating organized crime have been determined and disclosed. It is concluded that administrative and legal methods of counteracting organized crime is a system of means, methods and techniques by which administrative and administrative (managerial) influence of management subjects is exercised on objects of management, with the purpose of performing tasks, functions, competences and the authority to combat organized crime. It is emphasized that the effectiveness of the subjects of combating organized crime, the coherence of their activities, fully depend on the complex and effective use of administrative and legal methods that have no internal and external contradictions, but only complement each other.
