ОЦІНКА ДОКАЗІВ У СТРУКТУРІ КРИМІНАЛЬНОГО ПРОЦЕСУАЛЬНОГО ДОКАЗУВАННЯ

Abstract

The article is devoted to the research of the essence, functional purpose and content of the evaluation of evidences as an element (stage) of criminal procedural proof. On the basis of the analysis of the works of domestic and foreign scientists, the essence of the evaluation of evidences as a mental activity of the subjects of proof is characterized. The purpose of the evaluation of evidences is defi ned as the formation in the mind of the subject of criminal procedural proof of the conclusion about the relevance, admissibility, reliability of each evidence, the sufficiency of their totality and, with its consideration, - of the conclusion about the proof of facts and circumstances, that are subject to proof in the criminal proceedings. Th e content of the evaluation of evidences is considered as a set of methods, used by the subjects of proof to achievement of its purpose.
