Abstract

Various approaches to the definition of “violation of order” are considered. The features of the temporarily occupied territory of Ukraine as a place of committing a crime are analyzed. The importance of the theoretical understanding of means of committing a crime (under which a forged passport document and a special permit issued by a territorial body of the LMA or a territorial subdivision of the LMA in Novotroitsky or Genichesky districts of Kherson region should be considered for aliens and stateless persons, meanwhile for Ukrainian citizens - forged passport, or passport for departure abroad, or temporary Ukrainian citizen ID card, or diplomatic passport, or service passport, or sailor’s ID card, or crew member ID card, or card allowance to return to Ukraine (which allows to enter Ukraine) is substantiated. Crime instruments according to Art. 332-1 of the Criminal code of Ukraine are examined.
