ОСОБЛИВОСТІ КРИМІНАЛЬНОЇ ВІДПОВІДАЛЬНОСТІ ЗА ОДЕРЖАННЯ НЕПРАВОМІРНОЇ ВИГОДИ У РАЗІ СПРИЯННЯ ПОРУШЕННЮ ПОРЯДКУ В'ЇЗДУ НА ТИМЧАСОВО ОКУПОВАНУ ТЕРИТОРІЮ УКРАЇНИ ТА ВИЇЗДУ З НЕЇ

Abstract

The main features of criminal responsibility for acceptance of illegal benefit for assistance in violating of order of entering the temporary occupied territory of Ukraine and exiting it are described. The necessity of a conceptual study of criminal responsibility for violation of order of entering into and exiting from the temporary occupied territory of Ukraine (in context of which qualification issues should be of fundamental importance) is illustrated. The general provisions of the criminal-law qualification ofcrimes and differentiation of component elements of crimes as necessary condition of qualification are considered. Based on conducted research certain rules of qualification of the specified crimes are defined.
