СИНХРОНІЗАЦІЯ НАЦІОНАЛЬНИХ І ЄВРОПЕЙСЬКИХ ПРАВОВИХ СТАНДАРТІВ КРИМІНОЛОГІЧНОГО ЗАБЕЗПЕЧЕННЯ ЕКОНОМІЧНОЇ БЕЗПЕКИ

Abstract

The article is focused on studying the European legal standards of criminological provision of economic security, accomplishment of comparative and legal analysis of strategic documents and programs of criminological provision of economic security in certain EU countries, developed in regard to these standards, and on this basis on formulation of conclusions and propositions for their synchronization with national legal standards in this area. It has been noted that the standards of criminological provision of economic security in both Ukraine and the EU countries are directly reflected in the formed strategies and programs for combating crime. Their development and formation were carried out with obligatory consideration of general and highly specialized international and legal acts (recommendations, declarations, conventions, etc.). The state policy in the field of criminological provision of economic security in the aspect of synchronization with the European legal standards of criminological provision of economic security is implemented in Ukraine through the elaboration of a number of strategic documents (state-level strategies) and adopted legislative acts in order to implement them in different spheres of public life. Regarding the relevant programming documents, which assisted to realize the main strategic documents on combating crime in general, and economic crime in particular, we should note that there is the Concept of implementing the state policy in the field of prevention of offenses for the period up to 2015 in Ukraine, which is obviously morally outdated. This circumstance, along with the recently approved strategic documents for economic security of Ukraine, as an integral part of national security requires the rapid updating of the above mentioned concept, but it is also possible, the development and approval of the State Program for Criminological Provision of Economic Security. We may take into account the positive experience of certain EU countries in this area while forming such State Program in Ukraine.
