ІНСТИТУЦІЙНА СКЛАДОВА ДЕЦЕНТРАЛІЗАЦІЇ ЯК СИСТЕМНИЙ ЧИННИК ЕФЕКТИВНОСТІ ФУНКЦІОНУВАННЯ МІСЦЕВОГО САМОВРЯДУВАННЯ В М. КИЄВІ

Abstract

The article deals with the formal and legal analysis of the constitutional and legal basis of organization of public power in the capital of Ukraine; the practice of implementing legal acts regulating the organization, functioning and interaction of bodies and off cials of local self-government and local bodies of state executive power in Kyiv is investigated; the bills submitted for discussion by the Verkhovna Rada of Ukraine on the legal status of Kyiv and the public authorities are considered; a comparative study of the organization and activity of local self-government bodies and executive power in individual capitals of EUMember States was conducted. The study concludes that the decentralization reform is incomplete in Ukraine. As a result, there is an inefficiency of the mechanism of public authority, the lack of effective cooperation of local state executive bodies and local selfgovernment bodies and officials, which is particularly evident in Kyiv. Reforming the constitutional and legal status of the capital of Ukraine - Kyiv, improving the organization and activity of local self-government bodies, introducing their effective interaction with state authorities, including local ones, should be carried out on the basis of the principle of maintaining uniform rules for all local self-government bodies in Ukraine. The reform of decentralization of state power in terms of liquidation of local state administrations needs to be completed.
