АНАЛИЗ ПРАВОВОЙ ПРИРОДЫ НЕДОСТОВЕРНОЙ ИНФОРМАЦИИ КАК ОДНОГО ИЗ ВИДОВ ИНФОРМАЦИИ. МЕХАНИЗМЫ ЗАЩИТЫ ПРАВ ЛИЦ, В ОТНОШЕНИИ КОТОРЫХ РАСПРОСТРАНЯЕТСЯ НЕДОСТОВЕРНАЯ ИНФОРМАЦИЯ

Abstract

The article analyzes the legal nature of misleading information as one of the types of information, discusses issues related to the dissemination of false information, the establishment of legal liability for individuals who violate an «information» law of Ukraine and release these persons from such liability. Define the concept of «false information». Special attention is given to ways of protecting the person whose rights in the sphere of information relations were violated. Some mechanisms for the protection of the rights of persons for whom misleading information is disseminated are presented. Set out the basic legislative principles of information relations. Examined the provisions and some of the drawbacks of existing legal acts which regulate the rights and obligations of subjects of information relations. In this study attention is paid to the issues of violation of personal non-property rights of a natural person, in print or other media. Special attention is paid to the gaps in legislation in the fi eld of information technology, namely on the issues of legislative regulation of liability for dissemination of false information on the Internet. Issues regarding the responsibility for dissemination of false information for the ordinary citizen, a legal entity, a professional journalist and the media. The article lists special exemption from legal liability, in particular for journalists and media representatives. Reviewed existing national legislation and international legislation, ratified by Ukraine which regulate rights, obligations and rules of conduct for subjects of information relations, as well as the grounds and procedure of responsibility for individuals and legal entities, who cooperate in the sphere of information relations in Ukraine. Explained the difference between the disseminate of misleading information and the statement of value judgments.
