Abstract

This paper article focuses on differentiation of the relation in personam and absolute proprietary relations concerning budgetary money funds. The article substantiates the position that the rights in rem on the budget shall be determined exclusively by civil law. The rights in personam in the sphere of budget mobilization and allocation mainly included in the subject of financial law. The author critically evaluates arguments of some Russian scientists on direct regulation of the relations of property on the budgetary money by norms of financial law, but notes the significant impact of financial law on these relationships.
