ДО ДИСКУСІЇ ПРО ПЕРСПЕКТИВИ СТВОРЕННЯ В УКРАЇНІ МУНІЦИПАЛЬНИХ ОРГАНІВ ОХОРОНИ ПРАВОПОРЯДКУ

The article deals with the prospects for the creation of municipal policing bodies. The study of municipal lawenforcement bodies in the domestic and foreign legal sciences has been analyzed. There has been determined the preconditions for formation of domestic municipal policing structures as executive bodies of local self-government. The development and formation of local police in modern Ukraine has been analyzed along with the lawmaking level in this field. The existing practice of Ukrainian municipalities of creation of local policing agencies has been researched. Th e most common forms of solution of law enforcement tasks by local self-government bodies have been elucidated: structural units of executive bodies of local self-government; communal institutions not included in the system of executive bodies of local councils; communal companies with security functions; involvement of civil society organizations to the permanent law enforcement activities; involvement of the National Police on a contractual basis. It has been concluded that the formation of municipal law enforcement agencies requires the solution of a range of theoretical, legal and organizational problems: a comprehensive scientifi c analysis of the legal status of municipal policing agencies, the formation of the legal foundations for their organization, the development of a mechanism for the transition to decentralized policing forms; adoption of a law defining the organizational framework and the procedure for the municipal law enforcement agencies; development of the concept for a comprehensive solution of legal, organizational, fi nancial and other issues related to the transfer of some police functions to municipalities.
