ХАРАКТЕРИСТИКА ПРИНЦИПОВ ВЕДОМСТВЕННОГО КОНТРОЛЯ ЗА ДЕЯТЕЛЬНОСТЬЮ СУДОВ (СУДЕЙ) В УКРАИНЕ

Abstract

The article, based on an analysis of the scientific views of scientists, provides an author’s definition of the concept of departmental control over the activities of courts (judges) in Ukraine. The circle of principles of implementing departmental control in the field under study is outlined. The following principles of departmental control over the activity of courts (judges) in Ukraine are defined and characterized: rule of law and legality; principle of effectiveness and efficiency; principle of efficiency; principle of planning; principle of science; principle of professionalism; the principle of the reality of punishment in the event of a deviation from compliance with applicable law by judges principle of distribution of competencies of controlling entities; the principle of respect for the independence, independence and inviolability of judges; the principle of interaction of subjects of control. It was found that the principles of the rule of law and rule of law are key (basic) in the implementation of any activity. They stipulate that when implementing departmental control over the activities of judges, the following must be observed: firstly, the norms of the current legislation that determine the legal basis for the activities of judges in Ukraine, and also regulates the work of subjects of departmental control; secondly, the norms of morality, ethics, as well as existing legal customs and traditions. In addition, it is indicated that the rule of law and rule of law underlie the formation and implementation of other principles of departmental control over the activities of courts (judges) in Ukraine. It is proved that the principles of departmental control over the activities of courts (judges) in Ukraine are not just the initial principles (ideas) that underlie the implementation of the relevant activities. They represent a certain starting point, the source on which relations should be built in the exercise of control activities by authorized entities, their observance is mandatory for all participants in these legal relations, and any deviation from them should entail the onset of negative consequences in the form of legal liability.
