Abstract

The article is devoted to the consideration of the issue of the right to conclude a marriage contract. The concept of spouses is explored. For the formation of a unifi ed approach, the most widespread views in the legal literature on the notion of marriage and the family as a legal category have been analyzed, their signs have been singled out. It is emphasized that the category of marriage should be understood as a legal status that arises from the state registration of the will of two different sexes, creating for them certain legal consequences. It is concluded that the right to conclude a marriage contract is due to the spouses, that is, the persons whose marriage is registered in the civil registration offices, or the persons who have stated the intention to marry - have already married and have already applied to the appropriate marriage registration authority.
